Terms and conditions

Delivery of Services and Terms and Conditions

These General Terms and Conditions of Sale apply to any order you place for Safe&Well Services (as advertised on www.safeandwell.co.uk) as a consumer. You must read these General Terms and Conditions of Sale carefully. By placing an order you confirm that you have read, understood and agree to these General Terms and Conditions of Sale in their entirety. If you do not agree to these General Terms and Conditions of Sale in their entirety, you must not order any service. Value Added

VAT will be charged at the prevailing rate on all applicable services. Our prices are shown in pounds sterling including VAT.

Prices

Prices shown for Occupational Therapist Home Visits are for visits within the specified area only. We reserve the right to change prices without prior notice at any time. Prices charged will be those in force at the date of the Customer's order.

Order Placement

Services can be requested by completion of the Contact Form on the website or by calling the local service centre as detailed on the Website. The contract will be considered to have commenced once you have agreed an assessment and received our email or postal order confirmation.

Availability of Services

Services contained on the Website are offered subject to availability. Under normal circumstances all services are available within 7 working days. If, however, the service is not available within the stated timescale, for example due to increased demand or staff illness, we will advise you promptly and endeavour to supply the service as soon as possible. Payment

Payment is to be made at least 24 hours before the appointment time for an Occupational Therapist Home Visit by credit/debit card and by telephoning our customer service team on 0345 120 4522.

Cancellation or change of Appointment Time for Occupational Therapist Home Visit

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) ("CCR") you have a right to cancel all or part of your contract at any time up to 14 days prior to the delivery of the service without giving any reason. If you require the service to be delivered within this 14 day period, this will be confirmed via your booking and you have a right to cancel all or part of the contract at any time prior to the delivery of the service.

To exercise the right to cancel you must inform us, within the cancellation period, of your decision to cancel this contract by E-mail to enquiries@safeandwell.co.uk or by writing to:

You may also use the Cancellation Form to exercise your right to cancel, but it is not obligatory.

Customer not available at property on arrival - We reserve the right to retain 20% of the charge of the Occupational Home visit when a customer is not present at the property without informing us first.

If we are unable to attend the visit due to unforeseeable circumstances, we will either arrange a new appointment or provide a full refund.

Any refunds will be made within 14 days of the cancellation of the Home Visit.

Description

The Company is continually seeking to improve the quality and value of its goods and services. Whilst every care is taken to ensure illustrations and descriptions on our website are accurate and informative, we do reserve the right, if appropriate, to change service specifications or improve our services.

Customer Care

For the purposes of internal training we will from time to time monitor and sometimes record customer telephone communications. Confidentiality for our customers is assured at all times.

Complaints

Should the customer wish to formally complain, they should write to the Clinical Service Lead by E-mail to enquiries@safeandwell.co.uk or by post to: NRS Healthcare, Sherwood House, Cartwright Way, Forest Business Park, Bardon Hill, Coalville, Leicestershire, LE67 1UB. The complaint will be promptly acknowledged and should the complaint not be resolved within five working days the company will provide regular feedback until full resolution.

Advice and Information Given

Any advice and information given to you when using any of our telephone or online services is based solely on the information provided by the customer. We will do our best to advise but we cannot be held responsible if any products purchased as a result do not meet the customers need.

Our Liability

There are certain liabilities which we cannot exclude by law and nothing in these General Terms and Conditions limits our liability for personal injury or death caused by our negligence or for fraud.

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms and Conditions. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms and Conditions by anything you (or anyone acting on your behalf) does or fails to do.

We shall not be liable to you in contract, tort (including negligence) or otherwise for:

Our Staff

All our staff who deal with customers are enhanced DBS checked and all Occupational Therapists are professionally qualified and registered with the British Association of Occupational Therapy and the Health and Care Professions Council (you can check for registration here).

Assignment, waiver and third party rights

We may update or amend these General Terms and Conditions of Sale from time to time to comply with law or to meet our changing business requirements without notice to you. Any updates or amendments will be posted on the Website.

You may not assign or sub-contract any of your rights or obligations under these General Terms and Conditions of Sale to any third party unless we agree in writing.

If any of these General Terms and Conditions of Sale are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these General Terms and Conditions of Sale shall remain in full force and effect.

Only you and we shall be entitled to enforce these Terms of Sale. No third party shall be entitled to enforce any of these Terms of Sale, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

These General Terms and Conditions of Sale are governed by the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings you must do this within the United Kingdom.
